IMPORTANT NOTICE
Please read these Terms & Conditions carefully before registering for or using thuso.
These Terms & Conditions constitute a legally binding agreement between you and The Building Company (Pty) Ltd in relation to your access to and use of the thuso application and related services.
Certain provisions limit or exclude liability, allocate risk or responsibility to you, require an indemnity, or constitute acknowledgements. Nothing in these Terms is intended to exclude rights that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 or other applicable law.
By registering for, accessing or continuing to use thuso, you agree to these Terms. If you do not agree, you should not register for or use thuso.
1. About thuso
thuso is a digital platform designed to help contractors, tradespeople, customers and clients access selected building-related services and functionality from one place.
Depending on the services available to you, thuso may enable you to:
- create and manage a profile;
- create quotations;
- create and manage projects;
- communicate with clients or contractors;
- browse materials and product catalogues;
- check indicative stock availability;
- place or request orders;
- manage supported trade or Credit Accounts;
- access invoices, statements, proof of delivery documents and credit notes;
- access approved virtual-card functionality;
- interact with participating stores and brands; and
- use additional services introduced from time to time.
Not every feature will necessarily be available to every user, account, store, brand, region, device or operating system.
Features may be introduced, modified, suspended or withdrawn from time to time.

All formal legal notices must be delivered to the address specified above unless we notify you otherwise.
References to “thuso”, “we”, “us” and “our” refer to the entity operating thuso and, where the context requires, its participating brands, subsidiaries, affiliates or service providers.
3. Definitions
In these Terms & Conditions:
“App” means the thuso mobile application and any associated web-based functionality.
“Client” means a person for whom a Contractor or Tradesperson creates or manages a quote, project or related service using thuso.
“Contractor” means a person or business using thuso for contracting, building, trade, renovation, maintenance or related activities.
“Credit Account” means a qualifying customer, trade, commercial or staff account maintained by a Participating Brand and made accessible through thuso.
“Personal Information” has the meaning given to it in the Protection of Personal Information Act 4 of 2013 (“POPIA”).
“Participating Brand” means a retail or other business whose stores, products, services, customer accounts or other functionality are made available through thuso.
“Services” means the functionality, information and services made available through thuso from time to time.
“Terms” means these Terms & Conditions, as amended from time to time.
“User”, “you” or “your” means the person accessing or using thuso.
“Virtual Card” means any digital barcode, QR code, credential or other digital identifier made available through thuso to identify or facilitate authorised use of a linked account.
4. Eligibility
You must be at least 18 years old to register for and use thuso independently.
By registering, you confirm that you are legally capable of entering into a binding agreement, that the information you provide is true and accurate, that you are authorised to use any business or Credit Account you link to your profile, and that if you act for a company, employer or other person you have appropriate authority to do so.
We may request reasonable information or documentation to verify your identity, age, contact details, account authority or other information necessary to protect users, accounts or our systems.
5. Registration
Registration for a standard thuso profile is currently free unless we expressly state otherwise for a particular service.
You must provide the information requested during registration. Some information may be optional while other information is required for particular features.
Your profile is personal to you and may not be transferred to another person.
You may not create a profile using another person’s identity without lawful authority, impersonate another person, intentionally submit false or misleading information, create accounts for fraudulent or unlawful purposes, or allow another person to use your profile as if it were their own.
We may decline, suspend or terminate a registration where we reasonably believe information supplied is false or misleading, the account is being used unlawfully, fraud or attempted fraud has occurred, the account presents a security risk, or these Terms have been materially breached.
6. Email and mobile-number verification
We may require you to verify your mobile number and/or email address.
Certain features may remain restricted until required verification has been completed. An unverified user may be permitted to prepare information in the App but may be prevented from completing certain transactions or submitting certain content.
Verification may include email verification links, one-time passwords (OTPs), SMS verification, identity verification or additional security checks.
You must never disclose an OTP or security code to another person unless a specific authorised process expressly requires it.
7. Your account security
You are responsible for taking reasonable precautions to protect your thuso profile.
- keep passwords, PINs and authentication information confidential;
- protect your mobile device;
- use reasonable security controls on your device;
- prevent unauthorised persons from accessing your profile; and
- notify us promptly if you believe your profile, device or linked Credit Account has been compromised.
You are responsible for activity conducted through your profile to the extent permitted by applicable law, unless the activity arose from circumstances for which we are legally responsible.
We may temporarily restrict access where we reasonably believe this is necessary to protect you, another person, a Participating Brand or our systems.
8. Keeping your information accurate
You must keep your profile and contact information accurate and up to date, particularly your mobile number, email address, identity information, business information, account-authorisation information and delivery or project details.
We are not responsible for a failure to receive communications, security notifications or transactional information where the failure results from inaccurate information supplied by you, except where applicable law provides otherwise.
9. Identity information
Providing a South African identity number or passport number may be optional when creating a standard thuso profile.
Identity information may become mandatory where required for a particular service, including linking or accessing a Credit Account.
We may use identity information to verify the correct account holder, verify authority to transact, prevent fraud, recover access to a profile, assist where you lose access to your registered mobile number or email address, or comply with legal or regulatory requirements.
10. Contractors and tradespeople
thuso provides tools that Contractors and tradespeople may use to manage aspects of their own businesses.
Unless expressly stated otherwise, thuso does not employ Contractors using the App, appoint them as our agents, supervise their work, certify their qualifications, guarantee their workmanship, determine their labour charges, provide building, construction, architectural or engineering advice, or guarantee the outcome of any project.
A Contractor remains responsible for the accuracy of quotations, labour estimates, project pricing, taxes applicable to their business, project timelines, scope of work, legal and regulatory compliance, permits or approvals, workplace safety, workmanship, subcontractors, insurance and commitments made to Clients.
11. Relationship between Contractors and Clients
IMPORTANT: Unless we expressly state otherwise, thuso provides a platform that facilitates interaction between Contractors and Clients. We are not a party to the underlying construction, renovation, maintenance or service agreement between them.
Any agreement relating to scope of work, labour, workmanship, Contractor fees, project milestones, completion, defects, warranties provided by a Contractor or disputes relating to the Contractor’s services is ordinarily an agreement between the Contractor and the Client.
The fact that a quotation, project, message or document was created, accepted, transmitted or stored through thuso does not make us responsible for the Contractor’s performance.
Nothing in these Terms limits any direct liability that a Participating Brand may have in respect of goods or services it itself supplies.
12. Quotations
thuso may allow Contractors to prepare quotations for Clients.
A quotation may include materials, quantities, estimated prices, labour, services, Contractor mark-ups, project information, taxes and additional charges entered by the Contractor.
Contractors are responsible for verifying quotation details before submitting them.
A material price appearing in a Contractor quotation may differ from the price ultimately charged by a Participating Brand because of price changes, promotions, regional pricing, selected store, account-specific pricing, trade pricing, stock substitutions, quotation validity periods or errors.
Acceptance of a Contractor quotation does not itself guarantee the availability or price of products from a Participating Brand.
13. Projects
thuso may enable Contractors and Clients to create, view and manage projects, including project phases, tasks, timelines, status updates, quotations, photographs, documents, comments and messaging.
Project information is intended as a convenience and management tool. We do not guarantee that project information entered by a User is accurate, progress information reflects actual work performed, dates will be met, tasks will be completed, or a Contractor or Client will perform their obligations.
14. Communication between users
thuso may enable users to communicate through the App.
You must not use communication features to threaten or harass another person, transmit unlawful material, send unsolicited bulk communications, impersonate another person, distribute malware, commit fraud, infringe intellectual property rights or engage in abusive or discriminatory conduct.
We may investigate reported misuse and may restrict access where reasonably necessary.
15. Product catalogues
Participating Brands may make product information available through thuso, including descriptions, images, specifications, pricing, stock indications, product codes and store availability.
We endeavour to keep information accurate, but product information may change.
Product images are generally illustrative and the actual product may differ slightly in appearance, packaging or presentation.
You should verify critical dimensions, specifications, compatibility and suitability before purchasing a product or using it for a particular project.
16. Pricing
Prices displayed through thuso may depend on the Participating Brand, selected store, geographical region, account type, customer-specific pricing, applicable promotion, trade arrangements and product availability.
Prices may change from time to time.
We take reasonable steps to display accurate pricing. Genuine pricing or system errors may occur. Where an obvious error has occurred, the relevant Participating Brand may take reasonable steps to correct it, subject to applicable consumer law.
Where a final transaction takes place with a Participating Brand, the price confirmed as part of that transaction will apply, subject to applicable law.
17. Stock availability
Stock quantities or availability displayed through thuso may not always update in real time.
A product displayed as available may have been sold before an order is completed, be reserved for another customer, be physically unavailable despite a system quantity, be damaged or unsuitable for sale, or be located at another store or warehouse.
Stock is therefore only confirmed when the relevant Participating Brand accepts or fulfils the applicable order, subject to its applicable sale terms.
18. Orders
Where thuso permits you to submit an order, you must review the order before final submission.
Submitting an order may constitute an offer to purchase goods from the relevant Participating Brand. Unless otherwise stated, an order is only accepted once that Participating Brand confirms acceptance or performs the transaction in accordance with its applicable terms.
Before completing an electronic transaction, you will be given an opportunity, where required by law, to review the transaction and correct mistakes.
Orders may be declined or cancelled where stock is unavailable, pricing was materially incorrect, payment cannot be completed, the transaction fails security checks, the linked Credit Account cannot be used, delivery cannot reasonably be performed, or applicable law prevents fulfilment.
Where payment has already been collected for a cancelled transaction, any required refund will be processed in accordance with applicable law and the relevant Participating Brand’s refund processes.
19. Delivery and collection
Where goods are delivered or collected, additional fulfilment terms may apply.
You are responsible for supplying correct delivery information, recipient details, contact information and access information.
Delivery times shown in the App are estimates unless expressly confirmed otherwise.
Circumstances outside reasonable control may affect delivery, including severe weather, road closures, industrial action, supplier delays, system failures, load shedding or power interruptions, vehicle breakdowns and other force majeure events.
Nothing in this provision limits rights available to consumers under applicable law.
20. Returns, exchanges and refunds
Goods purchased from a Participating Brand are subject to applicable South African consumer law and the relevant Participating Brand’s lawful returns, exchange and refund policies.
Nothing in these Terms reduces any right a consumer has under the CPA or another applicable law.
21. Credit Accounts
thuso may allow qualifying users to link supported Credit Accounts.
A Credit Account is governed by the underlying agreement between the account holder and the Participating Brand that issued or administers the account. These Terms do not replace that agreement.
Before linking or accessing a Credit Account, we may require identity verification, account information, confirmation of authority, approval by the account holder, approval by the Participating Brand or additional security checks.
Access to a Credit Account through thuso does not confer any greater authority than the authority already granted to that user.
If your authority to use an account ends, you must stop using the account immediately.
22. Staff and authorised Credit Account users
An account holder may, where supported, authorise employees, representatives or other persons to access certain Credit Account functionality.
The account holder is responsible for appropriately managing its authorised users.
We or the relevant Participating Brand may restrict or remove a user’s access where the account holder requests it, the user’s employment or authority ends, fraud is suspected, the account is suspended, there is a security concern, or continued access would be unlawful or inappropriate.
23. Virtual Cards
IMPORTANT: A Virtual Card represents access to an underlying customer or Credit Account. You must protect it from unauthorised use.
Where available, thuso may provide a digital Virtual Card, barcode, QR code or other identifier.
A Virtual Card may only be used by the account holder or a person specifically authorised to use that account.
You may not sell a Virtual Card, transfer it to an unauthorised person, intentionally publish it, reproduce it for fraudulent use, permit another person to impersonate you, or use it after your authority has been withdrawn.
You must promptly report suspected misuse.
We or the relevant Participating Brand may deactivate, reissue or restrict a Virtual Card, or require additional verification where reasonably necessary for fraud prevention, account security or compliance purposes.
A Virtual Card itself does not create credit and does not alter the terms, credit limit, payment obligations or authorised-user conditions of the underlying Credit Account.
24. Account documents
Where supported, thuso may allow you to view or retrieve invoices, statements, proof of delivery documents, credit notes and transaction records.
These documents may originate from underlying financial, retail or account-management systems.
If you believe a document or transaction is incorrect, contact the relevant Participating Brand or customer-service channel.
Displaying information in thuso does not prevent a legitimate underlying record from subsequently being corrected.
25. Payments
Where thuso facilitates payment, payment may be processed by a Participating Brand, through a third-party payment service provider, against an eligible Credit Account or using another supported payment method.
Additional payment-provider terms may apply.
You must not attempt to use stolen payment credentials, circumvent payment controls, submit unauthorised transactions or interfere with payment systems.
26. Promotions, discounts and offers
Promotions made available through thuso may be subject to separate promotional terms.
Such terms may specify eligibility, Participating Brands, participating products, participating stores, dates, minimum spend, geographical restrictions, redemption limits or other conditions.
Where promotion-specific terms conflict with these Terms in relation to that promotion, the promotion-specific terms will apply to the extent of the conflict.
27. Future loyalty and customer benefits
thuso may introduce loyalty, rewards, digital receipt or customer-benefit functionality from time to time.
Where such functionality is introduced, additional terms may apply.
The availability of an account, profile or digital customer card does not automatically guarantee entitlement to rewards, discounts or future loyalty benefits.
28. Digital customer cards
Where thuso makes digital customer-identification cards available, a card identifies a customer profile, may be associated with a Participating Brand or region, may be used to associate qualifying transactions with that profile, and may support digital receipts or future customer benefits.
A digital customer card is not a credit card or debit card, has no inherent cash value and does not itself create an entitlement to credit.
29. Digital receipts
Where digital receipt functionality is available, you may elect to receive receipts or transaction records electronically.
You remain responsible for ensuring that your contact and profile information is accurate.
Certain physical or statutory records may continue to be issued or retained even where you elect to receive digital receipts.
30. Personal Information and privacy
Your Personal Information will be processed in accordance with our External Privacy Statement and applicable law.
The thuso Privacy Policy can be accessed in the App at Menu → Support & About → Terms & Policies → Privacy Policy and online at https://go.thuso.app/privacy.
The Privacy Policy explains what Personal Information we collect, why we collect it, how it is used, when it may be shared, international processing, retention, your privacy rights and how to submit a privacy request.
31. Information about Clients and other persons
If you enter another person’s information into thuso, including a Client’s name, email address, telephone number, project address or other Personal Information, you confirm that you have a lawful basis for doing so.
You must not use thuso to collect, process or disclose another person’s Personal Information unlawfully.
32. User-generated content
thuso may allow you to upload or create photographs, documents, messages, quotation content, project information, descriptions, logos or other content.
You remain responsible for content you submit and confirm that you have the necessary rights or permission to submit it.
You grant us a limited, non-exclusive licence to host, process, reproduce and display that content only to the extent reasonably necessary to operate thuso and provide the Services.
You retain ownership of your original content.
33. Prohibited content
You may not upload, create or transmit content that is unlawful, infringes another person’s intellectual property, contains malware or harmful code, is fraudulent, unlawfully discloses Personal Information, constitutes unlawful hate speech, is threatening or abusive, facilitates criminal conduct, or otherwise materially violates these Terms.
We may remove or restrict access to content where reasonably necessary.
34. Acceptable use
You may only use thuso for lawful purposes.
You may not hack or attempt to compromise the App, probe or scan our systems without authorisation, circumvent security mechanisms, reverse engineer the App except where law expressly permits it, scrape information using automated systems without permission, overload or deliberately disrupt our infrastructure, create fraudulent accounts, manipulate transactions, falsify account information, exploit software defects, distribute malware, access another person’s profile without authority, misuse APIs, or infringe the rights of others.
35. Fraud and misuse
We may investigate suspected fraud, identity theft, unauthorised account use, manipulation of Virtual Cards, abuse of promotions, suspicious transactions or misuse of thuso.
Where reasonably necessary, we may temporarily restrict functionality, suspend a profile, block a transaction, disable a Virtual Card or require additional verification.
Where appropriate, suspected unlawful conduct may be reported to law-enforcement authorities or other authorised bodies.
36. Intellectual property
Unless otherwise stated, the App and its underlying software, source code, designs, interfaces, trademarks, logos, graphics, databases, text, content and functionality are owned by or licensed to us or the relevant rights holder.
You are granted a limited, revocable, non-exclusive and non-transferable right to use thuso for its intended purpose.
No ownership rights in our intellectual property are transferred to you.
37. Participating Brand intellectual property
Names, trademarks, product images, logos and other intellectual property belonging to Participating Brands remain the property of their respective owners.
You may not use those rights except as permitted through ordinary use of thuso or with the appropriate rights holder’s permission.
38. Third-party services
Certain Services may depend on third-party technologies or providers, including services relating to cloud hosting, mapping, analytics, messaging, payment processing, identity verification, notifications or app distribution.
Third-party terms may apply where you use those services.
We are not responsible for an independent third party’s service beyond the extent required by applicable law.
39. Apple App Store and Google Play
If you download thuso through the Apple App Store or Google Play Store, the relevant store’s terms may also apply.
The store provider is not responsible for services provided independently by us except as required by its own terms or applicable law, and your use of the App remains subject to these Terms.
40. Availability of thuso
We aim to provide a reliable service but do not guarantee that thuso will always be uninterrupted, available, error-free, secure from every possible threat or compatible with every device.
Services may temporarily be unavailable because of maintenance, upgrades, system failures, network outages, third-party failures, cybersecurity incidents, infrastructure problems, power interruptions or circumstances beyond our reasonable control.
41. Updates
We may release App updates from time to time.
Certain Services may require a current version of thuso. Older App versions may eventually stop functioning correctly or may be prevented from accessing Services where necessary for security, compliance or technical reasons.
42. Changes to the Services
We may add, modify or discontinue features where reasonably necessary.
Where a change materially affects users, we will take reasonable steps to provide notice where appropriate.
Nothing in this provision allows us to make a change prohibited by applicable consumer law.
43. Suspension
We may suspend access to all or part of thuso where reasonably necessary because of suspected fraud, security risks, material breach of these Terms, unlawful activity, technical problems, legal requirements or the protection of users or Participating Brands.
Where appropriate and reasonably possible, we will provide information regarding the suspension.
44. Termination by you
You may stop using thuso at any time.
You may request deletion of your thuso profile through Menu → Support & About → Terms & Policies → Delete My Data or https://go.thuso.app/DSAR.
Profile deletion is subject to the retention requirements described in our Privacy Policy.
Deleting your thuso profile does not cancel amounts lawfully owing on a Credit Account, cancel an underlying agreement with a Participating Brand, cancel an order already accepted unless applicable cancellation rights allow it, or eliminate records that must lawfully be retained.
45. Termination by us
We may terminate or permanently suspend access where you materially or repeatedly breach these Terms, your account is used for unlawful purposes, fraud is established, your continued access creates a material security risk, or we are legally required to do so.
We may also discontinue thuso as a service. Where practicable, reasonable notice will be provided if the service itself is discontinued.
46. Accuracy of information
We take reasonable steps to keep information made available through thuso accurate.
However, certain information may originate from Users, Participating Brands, inventory systems, third-party systems, Contractors or external service providers and may occasionally be incomplete, delayed or incorrect.
Where you become aware of a material error, please report it so that it can be investigated.
47. No professional advice
Information provided through thuso is not intended to constitute architectural, engineering, structural, legal, financial, tax, occupational health and safety or other regulated professional advice.
Where professional advice is required, you should consult an appropriately qualified professional.
48. Product suitability and building use
You are responsible for confirming whether a particular product is suitable for your intended use.
For safety-critical or regulated building work, you should follow manufacturer instructions, applicable building regulations, approved plans, professional specifications and applicable South African standards.
49. Warranties
To the maximum extent permitted by applicable law, thuso is provided on an “as available” basis.
We do not provide warranties beyond those expressly stated by us, provided by the relevant supplier or manufacturer, or imposed by applicable law.
Nothing in these Terms excludes statutory warranties or consumer rights that may not lawfully be excluded.
50. Limitation of liability
IMPORTANT: THIS CLAUSE LIMITS OUR LIABILITY.
To the maximum extent permitted by applicable law, we will not be liable for loss arising solely from information supplied incorrectly by a User, unauthorised use caused by a User failing to take reasonable account-security precautions, a Contractor’s workmanship or failure to perform, a Client’s failure to perform obligations to a Contractor, third-party services outside our reasonable control, inaccurate project information entered by another User, or events outside our reasonable control.
We will not exclude or limit liability where doing so would be unlawful.
Nothing in these Terms is intended to exclude liability for gross negligence or other liability that applicable law prohibits us from excluding.
Nothing in this section limits a consumer’s statutory remedies against a Participating Brand for goods or services supplied by that Participating Brand.
51. Indemnity
To the extent permitted by applicable law, you indemnify us against third-party claims arising directly from unlawful content submitted by you, your infringement of another person’s intellectual property, fraudulent use of the Services by you, your deliberate misuse of another person’s account, Personal Information you unlawfully upload or disclose, or a material violation of these Terms by you.
This indemnity does not apply to losses caused by our own unlawful conduct or negligence where liability cannot legally be excluded.
52. Events beyond reasonable control
Neither you nor we will be responsible for a failure or delay caused by circumstances genuinely beyond that party’s reasonable control, subject to applicable law.
These circumstances may include natural disasters, severe weather, widespread communications outages, civil unrest, industrial action, government restrictions, national emergencies, major cybersecurity incidents, power-system failures or failure of critical third-party infrastructure.
The affected party must take reasonable steps to minimise the effect of the event.
53. Electronic communications
By registering for thuso, you agree that we may communicate with you electronically regarding your account and Services.
Electronic communications may include email, SMS, in-app messages, push notifications and other supported electronic channels.
These may include contractual notices, transaction confirmations, security alerts, account notifications and service announcements.
Electronic communications and transactions are recognised under South African law.
54. Direct marketing
Marketing communications are separate from essential service and security communications.
Where required by law, marketing will only be sent with the appropriate permission or other lawful basis.
You may opt out of direct marketing using the unsubscribe mechanism provided, the applicable App preference or the relevant customer-service channel.
Opting out of marketing does not prevent us from sending communications required to operate, protect or administer your account.
55. Notices
Any formal notice under these Terms may be delivered electronically where permitted by law.
You are responsible for keeping your registered email address and mobile number current.
A notice sent to the contact information registered to your account may be regarded as having been sent to your nominated electronic address, subject to applicable law.
56. Changes to these Terms
We may update these Terms from time to time because of new features, legal or regulatory developments, changes to Participating Brands, security requirements, technology changes or changes to our operating model.
The latest version will be published through the App and/or our website.
Where a change is material, we will take reasonable steps to notify affected users.
Where applicable law requires specific consent to a change, we will obtain that consent.
Continued use of thuso after an updated version becomes effective may constitute acceptance of the updated Terms where permitted by law.
57. Assignment
You may not transfer your thuso profile or assign your rights under these Terms without our written permission.
We may transfer our rights or obligations to an affiliate, successor, purchaser of the relevant business or another entity as part of a lawful corporate restructuring, provided that doing so does not unlawfully reduce your rights.
58. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as severable to the extent necessary.
The remaining provisions will continue to operate.
59. No waiver
If we do not immediately enforce a provision of these Terms, that does not mean that we have waived our right to enforce it later.
60. Entire agreement
These Terms, together with our Privacy Policy, applicable transactional terms, promotion-specific terms, Credit Account agreements and other terms expressly incorporated into a particular Service, constitute the relevant agreement governing your use of thuso.
Where there is a conflict, the terms relating most specifically to the relevant transaction or service will generally apply, subject to applicable law.
61. Governing law
These Terms are governed by the laws of the Republic of South Africa.
South African courts will have jurisdiction in relation to disputes arising from these Terms, subject to any statutory rights a consumer may have to approach another appropriate tribunal, regulator, ombud or dispute-resolution body.
62. Consumer rights
Nothing in these Terms is intended to prevent a person from exercising rights available under applicable South African legislation, including where relevant the Consumer Protection Act 68 of 2008, Electronic Communications and Transactions Act 25 of 2002, Protection of Personal Information Act 4 of 2013 and other applicable legislation.
Where a provision of these Terms would unlawfully waive or restrict a mandatory consumer right, that provision will apply only to the maximum extent permitted by law.
63. Complaints and dispute resolution

Nothing prevents a consumer from referring a matter to an appropriate regulator, ombud, tribunal or court where entitled to do so.
